1. Who we are and what these terms are for

The Tavern is a party games app for iPhone and Android. It is published by Ascent Studio App, a French SAS with a share capital of €1,000, registered with the Lyon Trade and Companies Register (RCS) under number 993 734 383 ("we").

These Terms of Use (the "Terms") set out the rules between you and us when you use The Tavern. By using the app, you accept these Terms. If you don't agree, don't use the app.

2. You must be 18

The Tavern is for adults only, aged 18 or over. Some content is suggestive ("Naughty" mode) and many challenges are designed for adults-only nights.

By using the app, you confirm that you are at least 18. If you play in a group, make sure all the players are adults.

3. What the app offers

The Tavern brings together several party games: questions, challenges, votes, team games and tests, with different modes and themes.

To play, you enter the players' first names and, for some games or modes, their gender and who they're attracted to. This information is only used to adapt the cards. It stays on your phone (see our Privacy Policy).

No need to create an account. The app contains no advertising.

The content changes over time: we may add, change or remove games, modes or cards, in particular to improve the app or fix a mistake.

4. Free version and VIP subscription

Part of the app is free. The rest of the games, modes and content is reserved for VIP members, with a paid subscription.

The VIP subscription:

The length of the free trial, the price and the period are those shown in the app and on the store at the time you subscribe. They may vary depending on your country, current offers (for example during a Happy Hour) or app versions.

If you don't cancel before the end of the free trial, the paid subscription starts and the store charges you.

You can cancel whenever you want from your Apple or Google account settings. Cancellation takes effect at the end of the current period: you keep VIP access until then. Deleting the app does not cancel the subscription.

5. Right of withdrawal

In principle, when you buy remotely, you have 14 days to change your mind (Article L.221-18 of the French Consumer Code).

The VIP subscription gives you access to digital content straight away. If, at the time of purchase, you expressly asked to access it immediately and acknowledged that you would lose your right of withdrawal, you can no longer exercise it once you've been given access (Article L.221-28, 13° of the French Consumer Code).

In all other cases, you can withdraw within 14 days of your purchase. As payment goes through Apple or Google, the request is made to them (see the "Subscriptions and refunds" page). You can also email us at [email protected]: we'll help you with the process.

Refunds are handled by Apple or Google, under their own rules. We cannot refund a purchase made on the App Store ourselves.

6. Playing responsibly

When you open the app, a message reminds you: "Drinking too much is dangerous to your health. No challenge is compulsory."

In practice:

You can share some results from the app: your Purity Test, the Battle Royale recap or your "My stats" page. The app then creates a link to ascentstudio.app, and you choose who you send it to.

What you need to know:

You can also share your Purity Test result image or save it to your photos. The app only does this when you ask it to.

8. Intellectual property

The app, its games, cards, text, images, logo, trademarks ("The Tavern" ("La Taverne"), "Ascent Studio App") and code belong to us or are used with permission.

We give you the right to use the app for personal, non-commercial purposes, on your devices, as long as you comply with these Terms. This right is neither exclusive nor transferable.

You may not:

Apple's terms (the App Store End User Licence Agreement) and Google Play's terms also apply, in addition to these Terms.

9. Availability and updates

We do our best to make the app work well, but we cannot guarantee that it will always be available and free of bugs or interruptions.

Some features need an internet connection (for example the "Would You Rather" percentages, the counter of parties going on now, current offers). Without a connection, they may not be displayed.

We update the app regularly. Some updates may be necessary to keep using it. If we permanently withdraw the app, we'll let you know in advance wherever possible, and we won't renew a subscription for a period you couldn't use.

10. Our liability

We are liable for our commitments under the conditions set by law, in particular for the conformity of digital content (Articles L.224-25-12 et seq. of the French Consumer Code).

We are not responsible for:

Nothing in these Terms limits your rights as a consumer, or our liability, where the law doesn't allow it.

11. Your personal data

We collect as little data as possible. Everything is explained in our Privacy Policy, available on ascentstudio.app and from the app's settings.

12. If these Terms change

We may change these Terms, for example when the app evolves or when the law changes. The date of the latest update is shown at the top of the page.

If a significant change affects you, we'll let you know in the app before it applies. If you don't agree, you can stop using the app and cancel your subscription.

13. Governing law and disputes

These Terms are governed by French law.

If there's a problem, email us first at [email protected]: we'll try to find an amicable solution.

Failing that, the dispute will be brought before the competent courts in accordance with the law. If you are a consumer, you can go to the court of the place where you lived at the time of the purchase or at the time of the event that caused the damage.

If you live in another European Union country, you also keep the protection of the mandatory rules of your country.

14. Language

These Terms may be translated into other languages. In the event of any difference between a translation and the French version, the French version prevails.
